Kajian terhadap polis asuransi pembiayaan terkait penerapan akad tabarru dan akad wakalah bil ujrah


Akad occupies a fundamental position in implementing the insurance contract between the Participants/Policyholder and Insurance companie. Insurance contract is not executed with proper Akad process causes the insurance contract becomes invalid even be forbidden (haram). Credit Life Insurance as one of life insurance products that are operated by sharia insurance companies should be run according to Principles of Islamic law. Akad applicable to the Credit Life Insurance product is akad tabarru' and akad Wakalah bil Ujrah. Master Policy as evidence of the insurance contract must meet the conditions set by the regulator. This is to ensure the insurance contract complies with the akad. Based on the condition, then there is a question of whether Blife Syariah Pembiayaan Policy issued by PT BNI Life Insurance Sharia Branch has met conditions set by the regulator in No. PMK. 01/PMK/2010 and with the rules of akad in Islamic law. To answer this problem do qualitative descriptive research. The research was conducted at PT BNI Life Insurance Branch and the data obtained with the technique of collecting data through interviews and open discussins, participant observation and documentation as the primary data. Secondary data was obtained through a review of policy documents, Aplication Form of Life Insurance, Regulation and Legislation dan fatwa of DSN MUI. Based on the interpretation of the results of the research, the writer have concluded that in principle Blife Syariah Pembiayaan Policy issued by PT BNI Life Insurance Branch has met conditions set by the regulator in No. PMK. 018/PMK/2010 and with the rules of akad in Islamic law. However in some cases, PT BNI Life Insurance Sharia Bracnh have to make sure policyholder have read all the causes in the policy.
