Settlement of insurance dispute could be settled by two ways are litigation and alternative dispute resolution. The alternative dispute resolution divides into 4 (four) catagories of the alternative dispute resolution, namely: Negosiation, Mediation, Consolidation, and Arbitration. Those are have advantages and disadvantages each other. Mediation is one of the alternative dispute resolution for settling insurance disputes. Indonesia Insurance Mediation (BMAI) was established in 2006 that is supported by several Insurance Associations, namely: Indonesia General Insurance Association, Indonesia Life Insurance Association, and Indonesia Social Insurance Association. It is a independent forms for mediating insurance disputes that may occurs in insurance field. Settlement through Indonesia Insurance Mediation (BMAI) has advantages, besides the settlement of insurance dispute is handled by competent mediators, the time process of settlement is also shorter then other way (Litigation). Moreover it also gives free service for parties that are disputing in insurance field. The basic concept of Indonesia Insurance Mediation (BMAI) is to forward win-win solution to mediate both parties (insurer and insured) that are disputing in insurance field. It has a goal to maintain the business relationship between both parties. In this thesis will explain the processes and procedures of settlement in Indonesia Insurance Mediation.
